PlumLife is committed to protecting the privacy rights of all visitors to our Web site, www.PlumLife.com. In addition, we assure you that the identity of anyone accessing our Web site or using the Service is kept strictly confidential.

PLUMLIFE DOES NOT RENT, SELL OR EXCHANGE OUR MAILING LIST WITH ANYONE. We diligently strive to be responsible in management practices and cost effective in our fund raising efforts and outreach campaigns.

We reserve the right to change the privacy policy at any time, and if we do, all updates will be posted on this page.

DESCRIPTION OF SERVICE AND TERMINOLOGY

The Service is a personal data management service that allows Members to consolidate his or her scheduling, task, contact and communication management on PlumLife. Based on such information, the Service may also present information relating to third party products or services ("PlumLife Offers").

Visitor is someone who visits www.plumlife.com but has not registered.

Member is someone who has given PlumLife their email address, has accepted the Terms and Conditions and, therefore, has the ability to use either the free or subscription versions of the Service.

Personal Information means any information that may be used to identify you, including, but not limited to, your name and email address. You provide us with this personally identifiable information voluntarily through optional submissions, such as registration forms and login pages. For example, to create an account with us and use PlumLife, you are asked to submit some basic registration information including a valid e-mail address and password. Also, you may choose to provide us with similar personally identifiable information about additional family members to enable others in your family to use your PlumLife account.

If you provide personal information, PlumLife uses this information to identify each authorized user, to customize your experience, secure your account and prevent fraud. PlumLife may retain and use this information to better address your needs and to determine how PlumLife's infrastructure, organization, software and our Web site can be improved.

For example, when you ask a question or indicate interest in a career with us, we may specifically ask for information about you, including, but not limited to name, address, phone number, e-mail address and/or demographic information. This information is used to fulfill the services you requested or to better our offerings to you and users like you.

WE DO NOT SHARE PERSONALLY IDENTIFIABLE INFORMATION WITH THIRD PARTIES. The only exceptions are when we believe we are required to do so by law or in the event of a sale of the company, in which case the new company will be bound by the same privacy requirements unless you are notified otherwise.

Private Content includes the calendar, task, contact and communication information that you voluntarily submit to PlumLife to help you organize and manage your life. Because you enter private content into your own secured account, this private content is accessible only to you and other family members who have the password to your account. WE DO NOT SHARE PRIVATE CONTENT WITH ANY THIRD PARTY. The PlumLife service includes relevant advertising and related links that may be based on the private content you have added to your account. We may provide third parties, such as advertisers, aggregated non-personally identifying information from your private content, so that they may deliver relevant advertising to you.

Public Content includes any information you submit to PlumLife outside of your secured account. For example, you may voluntarily provide information about yourself when you participate in PlumLife sponsored public contests, message boards, blogs, or other community features that are accessible by general visitors and other users. This information is public content because people do not need a password to access or view this content on our site. This public content (including photographs and videos) that you choose to post outside of your secured account is not private.

PERSONAL INFORMATION

Personal Information means any information that may be used to identify you, including, but not limited to, your name and email address. You provide us with this personally identifiable information voluntarily through optional submissions, such as registration forms and login pages. For example, to create an account with us and use PlumLife, you are asked to submit some basic registration information including a valid e-mail address and password. Also, you may choose to provide similar personally identifiable information about additional family members to enable others in your family to use your PlumLife account.

Changes to your registration information

You have the opportunity to review and modify your personally identifiable information and your private content any time you log onto your PlumLife account using an email address and password listed on the account.

PlumLife uses your information in the following ways:

Non-Personally Identifiable Information. PlumLife collects non-personally identifiable information from you as you use the PlumLife software and service. Similar to other web services, PlumLife automatically records information based on your account activity and use of our site. We do this to improve our service, and to customize content and advertising. In doing so, we collect the following four types of non-personally identifiable information, which we may share with third parties that help us operate the PlumLife service or software, such as advertisers, ad serving vendors, and business partners.
Aggregated Data. PlumLife collects user information and content (including private content) in the aggregate as you use our site and services to analyze our overall user demographics and usage patterns. Aggregate data does not contain any personally identifiable information.
Server Logs. PlumLife collects information from our server logs. These logs may include information such as your Internet Protocol address, browser details, the date and time of your request and certain information about your usage of our site and service.
Cookies. We may place a text file called a "cookie" on your computer. This cookie does not contain personal information and cannot retrieve personal information from your computer. Cookies enable us to relate your use of the site and services to information that you have specifically and knowingly provided. PlumLife uses cookies to track user traffic patterns, analyze our overall user demographics and usage patterns, serve advertising and to authenticate you on to the service. We encode our cookies so that only we can interpret the information stored in them.
You can refuse cookies by turning them off in your browser, but in doing so you will not be able to use the web version of our service.
Links. PlumLife may track whether links to external Web sites are followed, and whether advertisements provided to you are clicked.
Personalized Advertising. PlumLife leverages Google's personalized advertising service to help present relevant advertisements to you. If you would like to opt out of these personalized advertising services, you must become a subscriber (a paid user) of PlumLife.

THIRD PARTY OFFERS

WE DO NOT SHARE PERSONALLY IDENTIFIABLE INFORMATION WITH THIRD PARTIES. The only exception is when we believe we are required to do so by law. There are a number of separate products and services offered by third parties advertised by us through the Service that may be complementary to your use of PlumLife. If you choose to use these separate products or services, disclose information to the providers, or grant them permission to collect information about you, then their use of your information is governed by their privacy policies. You should evaluate the practices of external services providers before deciding to use their services. PlumLife is not responsible for their privacy practices. If you click on a link to a third party site, PlumLife encourages you to check the privacy policy of that site. PlumLife may present links in a format that enables us to keep track of whether these links have been followed and whether any action has been taken on a third party Web site. We use this information to improve the quality of the PlumLife Offers and customized content on the Service.

EXCEPTIONAL CIRCUMSTANCES

As PlumLife continues to develop its business, it might sell some or all of its assets to another company in connection with a business merger or acquisition. In such cases, customer information (including your personally identifiable information and private content) may be transferred to the company who is taking over PlumLife's service. The new company would be required to protect all the information that PlumLife has collected from its users under the same terms of this privacy policy.

ARCHIVING AND INFORMATION REMAINING ON SERVERS

Your data is yours. You can remove it anytime you want. When you request us to delete your account for the Service, your data will be permanently expunged from our primary production servers and further access to your account will not be possible. We will also promptly disconnect any connection we had established to your Account Information and delete all account credentials. However, portions of your data, consisting of aggregate data derived from your Account Information, may remain on our production servers indefinitely. Your data may also remain on a backup server or media. PlumLife keeps these backups to ensure our continued ability to provide the Service to you in the event of malfunction or damage to our primary production servers. We also reserve the right to use any aggregated or anonymous data derived from or incorporating your personal information.

PlumLife recommends routinely exporting a copy of your Private Content to a file on your computer's hard drive as an extra precaution against loss of data.

USES OF COOKIES AND TRACKING TECHNOLOGY

For example, these service providers may help us measure the performance of our online campaigns or analyze visitor activity on PlumLife. We may permit these service providers to use cookies and other technologies to perform these services for PlumLife. We do not share any personal information about our customers with these third party service providers, and these service providers do not collect such information on our behalf. Our third party service providers are required to comply fully with this Privacy and Security Policy.

Web beacons are images embedded in a Web page or email for the purpose of measuring and analyzing site usage and activity. PlumLife, or third party service providers acting on our behalf, may use Web beacons to help us analyze Site usage and improve the Service.

USES OF E-MAIL ADDRESSES

PlumLife may send, and reserves the right, to send periodical e-mails as a method of outreach and encouragement to our members and partners. You will not receive such e-mail messages unless at the time you provided us with your e-mail address you indicated that you wished to receive such correspondence. If you are asked for your e-mail address and not given the opportunity to opt-out of receiving additional information, then the e-mail address is to be used for the specific service you requested only and will be deleted when you request the service be discontinued. You may request discontinuation of e-mail messages by sending such request by e-mail to webmaster@PlumLife.com

OUR COMMITMENT TO SECURITY

PlumLife is strongly committed to protecting your information. PlumLife uses several industry best standard methods of securing user information and data. Examples of our security measures include, where appropriate, firewalls and secure socket layers. We also maintain strict limits on who at PlumLife can access the information databases that contain your information. PlumLife has/uses the following:

Like many other companies, PlumLife does not own our servers and contracts with Amazon Web Services (AWS) to provide those services. From Amazon, "Enabling customer to ensure the confidentiality, integrity, and availability of their data is of the utmost importance to AWS, as is maintaining trust and confidence." YOUR ROLE IN SECURITY

You are responsible for maintaining the confidentiality of your Login ID, Password and the url (location) of any calendars that you choose to share. We maintain strict rules to help prevent others from guessing your password. We also recommend that you change your password periodically. Your password must be 6-8 characters in length. You are responsible for maintaining the security of your Login ID and Password. You may not provide these credentials to any third party. If you believe that they have been stolen or been made known to others, you must contact us immediately at security@PlumLife, but in any event you should change your password immediately via the Service. We are not responsible if someone else accesses your account through Registration Information they have obtained from you or through a violation by you of this Privacy and Security Policy or the PlumLife Terms of Use.

Protect your computer's security

Keep your computer and browser software current with security updates;
Install and update anti-virus and anti-spyware software and use personal firewalls to protect your computer;
Be alert to the threats posed by malware--(malicious software) which can damage or disrupt your system, or secretly record information such as keystrokes;
Do not enable automatic login to your PlumLife account or pre-fill the Login ID or password fields;
Change your password periodically and avoid using passwords for PlumLife that you commonly use for other purposes; and

Using your computer in a safe manner

Do not share your Login ID and password with anyone;
Check to make sure you are interacting with a secure Web site, as above;
Always log off after completing your activities on PlumLife.
Be careful about using third-party computers or computers that you are not familiar with such as those in Internet cafes and be careful to ensure you have fully logged out.

Information that you post

If you use a bulletin board, blog or chat room on our Site, you should be aware that any information you submit there can be read, collected or used by other users and could be used to send you unsolicited messages. We are not responsible for the personal information you choose to submit in these forums. These forums may be hosted by PlumLife or by one of our third party service providers on PlumLife's behalf.

You agree and understand that you are responsible for maintaining the confidentiality of your password which, together with your LoginID e-mail address, allows you to access the Service. That Login ID and password, together with any mobile number or other contact information you provide form your "Registration Information."

By providing us with your e-mail address, you agree to receive all required notices electronically, to that e-mail address. It is your responsibility to update or change that address, as appropriate. Notices will be provided in HTML (or, if your system does not support HTML, in plain-text) in the text of the e-mail or through a link to the appropriate page on our site, accessible through any standard, commercially available internet browser.

If you become aware of any unauthorized use of your Registration Information, you agree to notify PlumLife immediately at the email address - legal@plumlife.com

EMAIL NOTIFICATION

Electronic alerts will be sent to the email address you have provided as your primary email address for PlumLife. If your email address or your mobile device's email address changes, you are responsible for informing us of that change.

RIGHTS YOU GRANT TO US

By submitting information, data and other content to PlumLife through the Service, you are licensing that content to PlumLife solely for the purpose of providing the Service. PlumLife may use and store the content, but only to provide the Service to you.

Removal of inappropriate information

We may and will make efforts to, but have no obligation to, remove User Content and accounts containing User Content that we determine in our sole discretion to be unlawful, offensive, abusive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or other rights, or these Terms of Use. While we prohibit offensive and unlawful conduct and content on our Site, you understand and agree that neither PlumLife nor its Partners is responsible or liable for the User Content posted on the Site. You may be exposed to such materials and agree to use the PlumLife Site at your own risk. PlumLife reserves the right to discontinue any aspect of the PlumLife Site at any time, including discontinuing any linked or embedded User Content either generally or in specific cases.

LAWS OF THE STATE OF TEXAS AND US APPLY

This site is controlled by PlumLife, LP from its offices within the United States of America. PlumLife, LP makes no representation that information in this Site is appropriate or available for use in other locations, and access to this Site from countries or territories where the Site's content is illegal is prohibited. If you access this Site from outside the United States, you do so on your own initiative and you are responsible for compliance with all applicable local laws. The laws of the State of Texas govern these Terms and Conditions of use, without giving effect to its conflict of laws' provisions.

International Use

PlumLife's site and services are hosted in the United States. If you are visiting our website from outside the United States, you are transferring your personal data into the United States when you use the PlumLife service. Many regions, such as the European Union, have data collection protections that differ from U.S. law.

USE OF SITE

Licenses

Subject to the terms of this Agreement, we grant to you a limited, personal, non-exclusive, non-transferable license to use the Software solely to use the Service to the extent you have the right to access the Service. Your right to access the Service will be limited by the terms of this Agreement. Except for this license granted to you, we retain all right, title, and interest in and to the Software, including all related intellectual property rights. The Software is protected by applicable intellectual property laws, including United States copyright law and international treaties. Except as otherwise explicitly provided in this Agreement or as may be expressly permitted by applicable law, you will not, and will not permit or authorize third parties to: (a) reproduce, modify, translate, enhance, decompile, disassemble, reverse engineer, or create derivative works of the Software; (b) rent, lease, or sublicense the Software; nor (c) circumvent or disable any security or technological features or measures in the Software. When you post Public Content, you hereby grant (or warrant that the owner of the Content grants) us a royalty-free, perpetual, irrevocable, fully sublicensable, worldwide, non-exclusive right to use, reproduce, modify, translate, adapt, publish, create derivative works of, transmit, distribute, perform, display, delete (in whole or in part), and incorporate the Public Content for any purpose and without acknowledgement to you. By posting or providing Public Content, you represent and warrant that public posting and use of your Public Content by us will not infringe on or violate the rights of any third party.

Access and Interference

You agree that you will not:

Use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor PlumLife or any portion of PlumLife, without PlumLife's express written consent, which may be withheld in PlumLife's sole discretion;
Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search PlumLife, other than the search engines and search agents available through the Service and other than generally available third-party web browsers (such as Microsoft Explorer);
Post or transmit any file which contains viruses, worms, Trojan horses or any other contaminating or destructive features, or that otherwise interfere with the proper working of PlumLife or the Service; or
Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of PlumLife or the Service.

MOBILE USAGE

The Site, Software and Services include mobile features that allow you to access information in your account from your mobile phone. PlumLife does not charge for use of these features, but your mobile service provider may do so. Message and data rates may apply. Text messaging features are available only in the United States. The number of messages generated and received depends completely on the number of times you ask that messages or appointment reminders be sent to a mobile phone number.

AUTOMATIC FEATURES

The Software contains a feature that allows it to automatically update to incorporate new versions of the Software. If you interrupt or disable this feature, your copy of the Software may not operate correctly. The Software may contain a feature that is used to automatically disable the Software to ensure that you do not use the Software longer than the term of your license to use the Software or your subscription to use the Services. You acknowledge that upon the expiration of your license to use the Software, and if PlumLife has not granted you an extension, the Software may cease to function in some or all respects, and you may lose access to the Services and data made with or stored using the Software. You acknowledge that the disabling of the Software is a key feature of the license rights and responsibilities conveyed under this Agreement.

AGE AND RESPONSIBILITY

PlumLife takes protection of children and their personal information very seriously. By accepting the Terms and Conditions to use PlumLife, you acknowledge and verify that you are over the age of 18.

PRIVACY

For information about PlumLife's data protection practices, please read PlumLife's Privacy and Security Policy, which is hereby incorporated into this Agreement. This policy explains how PlumLife treats your personal information when you access PlumLife and use the Service.

The policy may be updated from time to time at our discretion. Changes will be effective upon posting to the site.

LIMITATION OF LIABILITY

PLUMLIFE SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO PLUMLIFE, YOUR USE OF THE SERVICE OR THIS AGREEMENT, EVEN IF PLUMLIFE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, PLUMLIFE'S LIABILITY TO YOU FOR ANY CAUSE WHATEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO $500.00 (FIVE HUNDRED UNITED STATES DOLLARS).

THE LIABILITY OF PLUMLIFE AND ITS AFFILATES, SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS UNDER THESE TERMS OF USE IS LIMITED TO DIRECT, OBJECTIVELY MEASURABLE DAMAGES. PLUMLIFE AND ITS AFFILATES, SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS WILL NOT BE HELD LIABLE FOR ANY INDIRECT OR SPECULATIVE DAMAGES (INCLUDING, WITHOUT LIMITING THE FOREGOING, CONSEQUENTIAL, INCIDENTAL, AND SPECIAL DAMAGES) INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, BUSINESS INTERRUPTIONS, AND LOSS OF PROFITS, REGARDLESS OF WHETHER THESE PARTIES HAD ADVANCE NOTICE OF THE POSSIBILITY OF ANY SUCH DAMAGES.

THE LIABILITY OF PLUMLIFE AND ITS AFFILATES, SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SOFTWARE, THE SERVICES, THE CONTENT, THE SITE, OR THESE TERMS OF USE, WHETHER IN CONTRACT OR IN TORT, SHALL NOT EXCEED $100. EACH PROVISION OF THESE TERMS OF USE THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS TO ALLOCATE THE RISKS UNDER THESE TERMS OF USE BETWEEN THE PARTIES. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS OF USE.THE LIMITATIONS IN THIS SECTION WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY UNDER THESE TERMS OF USE. Some states do not allow the foregoing limitations of liability, so they may not apply to you.

INDEMNIFICATION

In the event that you have a dispute with one or more users of the Site or the Services, you release PlumLife (and our officers, directors, agents, subsidiaries, parent corporation, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

You agree to indemnify and hold PlumLife, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, arising out of, resulting from or connected with the use, modification, misinterpretation, misuse, or reuse by you of the Software, the Site, the Services, or Content, including without limitation these Terms of Use.

DEALINGS WITH THIRD PARTIES

In connection with PlumLife Offers, the Service will provide links to other web sites belonging to PlumLife advertisers and other third parties. PlumLife does not endorse, warrant or guarantee the products or services available through the PlumLife Offers (or any other third-party products or services advertised on or linked from our site), whether or not sponsored, and PlumLife is not an agent or broker or otherwise responsible for the activities or policies of those web sites. This obligation shall survive the termination or expiration of these Terms and/or your use of the Service. You acknowledge that you are responsible for all use of the Service using your account, including any use by Sub-accounts, and that these Terms apply to any and all usage of your account, including any use by Sub-accounts. You agree to comply with these Terms and to defend, indemnify and hold harmless Plum Life from and against any and all claims and demands arising from usage of your account or any Sub-account, whether or not such usage is expressly authorized by you.

ADVERTISMENTS, PROMOTIONS and SURVEYS
